California law
What AB 468 changed, and why it protects you.
California set a standard for emotional support animal documentation in 2021. It is the reason a proper assessment takes a month, and it is also the reason a proper assessment is worth having.
Before 2022, anyone with an internet connection could buy a document calling itself an ESA letter. Landlords knew it, so they discounted all of them, including the honest ones. People with genuine need were the ones who paid for that.
Assembly Bill 468 was signed on 16 September 2021 and took effect on 1 January 2022. It added a new article to the California Health and Safety Code, sections 122317 to 122319.5, and it does two things: it tells businesses selling emotional support dogs what they must disclose, and it tells health care practitioners what they must do before issuing documentation.
What a practitioner must do
Section 122318 sets out the requirements. A health care practitioner providing documentation of a person's need for an emotional support dog must:
- Hold a valid, active license, and state the license's effective date, number, jurisdiction and type in the documentation itself.
- Be licensed to provide professional services within the scope of that license in the jurisdiction where the documentation is provided.
- Establish a client-provider relationship with the person at least 30 days before providing the documentation.
- Complete a clinical evaluation of the person regarding the need for the animal.
- Give written notice that knowingly misrepresenting an animal as a service dog is a misdemeanor.
Read that list again as a buyer rather than a clinician. Every item is something you can check before you pay. If a website cannot show you a named, California licensed practitioner and will not tell you when your relationship with them begins, it cannot meet this standard.
What sellers must disclose
Section 122317 covers anyone who sells or provides a dog marketed as an emotional support animal. They must give written notice that the dog does not have the rights and privileges of a service dog, and that knowingly representing it as one is a misdemeanor under Penal Code section 365.7. The article also carries civil penalties for violations.
A note on the word "certification"
The statute talks about documentation, because documentation is what exists. There is no official registry or certificate for an emotional support animal, in California or anywhere else. Any website selling you a registration, an ID card or a certificate is selling a novelty item. If you have seen the word certification used around emotional support animals, including on older pages of this practice's own website, read it as shorthand for an assessment and a letter. I have changed the wording here because precision protects you when a property manager starts asking questions.
What this means in practice
It means the honest answer to "how fast can I get a letter" is about a month, and anyone telling you otherwise in California is either unaware of the law or counting on you being unaware of it. It also means that when your documentation does arrive, it carries the things a housing provider is entitled to see.
Questions about the California rules
When did the 30-day rule start?
1 January 2022. Assembly Bill 468 was signed on 16 September 2021 and added a new article to the Health and Safety Code covering emotional support animals.
Does the 30 days have to be therapy?
The statute requires a client-provider relationship and a clinical evaluation. In practice that means real clinical contact rather than a form submitted a month before the letter is printed. If a provider tells you the 30 days can be served by waiting rather than by meeting, be careful.
What happens to a letter that does not meet these requirements?
A housing provider who receives documentation missing the license details or the relationship date can reasonably come back and ask for something adequate. You are then starting over, often with a deadline running.
Does this law apply if I bought my letter from an out-of-state website?
The practitioner has to be licensed to provide services within the scope of their license in the jurisdiction where the documentation is provided. A practitioner licensed only in another state is not in a position to meet that for a California resident.
Start the 30 days today
The clock only runs once a relationship exists. If housing is the pressure, the sooner we begin the sooner the documentation can be issued.
